Today, a federal judge with lifetime tenure, appointed by former POTUS Don Capone, issued a written opinion that should lead to that judge’s impeachment and then trial for violating her judicial oath.
Talking heads from across the political spectrum, including legendary legal progressive Bill Barr, have weighed in regarding the stupidity of Judge Cannon’s written decision and the way in which she brought shame to the law.
What I thought I’d do is just quote from the decision and let you decide:
Judge Cannon referred to her “equitable jurisdiction and inherent supervisory authority.” She made that up. She had no such authority. She was not the judge involved with the search warrant.
“there are disputes as to the proper designation of the seized materials..”
Disputes? The sworn declaration of an FBI expert referred to the photos of docs marked “Classified” and said, if you’ll pardon the expression: “them thars classified!” Trump legal response? Not one bit of evidence that the docs were not classified.
“evenhanded procedure does not demand unquestioning trust in the determinations of the Department of Justice.” That is a frightening statement by a federal judge.
“the principles of equity require the Court to consider the specific context at issue, and that consideration is inherently impacted by the position formerly held by Plaintiff.”
This last is the line that should scare all regarding the judicial oath for equal Justice under law. This judge again admitted that because Plaintiff is a former POTUS, he gets special treatment.
It is indeed a sad day for American legal history and the rule of law.
First - I'm scared - The ads saying "retire to Portugal are looking better and better".
Second - Isn't there a higher court the DOJ can appeal to?
